Draft license terms — not effective
For review only. These draft terms have not completed legal review and are not the effective terms for a new purchase. New purchases remain closed. Existing purchases retain their original terms.
design-pick Pro — End User License Agreement (draft)
1. What this covers, and the license
The licensor is lo9os, an independent software developer based in South Korea (contact@lo9os.org).
This agreement covers two things, together "Pro": the @design-pick/pro package (headless verify, before/after pictures made by the command-line tool, the CI design-regression check), and the design-pick Chrome extension, including its Pro features (before/after browser screenshots and pixel comparison, plus source-file/line hints and rendered-property comparison in the 0.3.2 review build). Both are licensed, not sold.
A purchase grants a non-transferable license to use the Pro product under this agreement. Ownership of the software remains with the licensor.
The extension may also be used without a key, free of charge, for element selection and basic HTML element/CSS context copying on supported websites. Source hints and open-tab rendered-property diffs were also free in the previous 0.3.1 extension. The 0.3.2 review build moves source hints and property comparison to Pro and is submitted for review, not publicly released. Existing MIT CLI functionality is unchanged. Chrome-protected pages remain unavailable. Everything else in this agreement applies to free extension use as well, except the sections on plans, payment and refunds, which concern the paid features.
2. One-time purchase and updates
- New purchase price: US$29 once. No automatic renewal or recurring charge.
- The purchase includes the Pro features available at purchase and new paid features first released before the end of the following 12 calendar months. The window starts when payment is confirmed. Included features may be used indefinitely under this agreement, subject to the license checks below.
- New paid features first released at or after that boundary require an optional additional purchase. There is no automatic renewal. Installing a newer build, including an automatic Chrome Web Store update, does not by itself grant those features or remove included features.
- Fixes and security updates to an included feature retain that feature's identity. The end of the new-feature window does not expire the usage license. It does not promise perpetual support, future feature development, or compatibility with future systems.
Activation, online validation and offline use
Included features do not expire merely because the new-feature window ends. Pro requires activation and periodic online license validation. A known valid license is rechecked every 3 days during the first 30 days after activation, then every 30 days. If the license service cannot be reached when a check is due, Pro allows up to 14 additional days of offline use with a warning. Once that grace period ends, Pro features stop until a successful online check restores access. A license's original expiry or revocation can end access earlier. Basic element selection and copying remain available without active Pro. Property verification is also free in 0.3.1 and requires Pro in the 0.3.2 review build. The 0.3.2 worker reads saved Pro status to select optional advanced features; without a saved key it does not contact Polar.
Use “Remove key from this browser” to request release of that browser activation. If the service is unavailable, the local record is still removed but the server activation may remain. For command-line activations or a device you cannot access, use the Polar customer portal or contact support. Deleting cached records or uninstalling alone does not release a server activation. The browser and command-line tool keep separate local license records. Do not share your full license key by email.
Payments are processed by Polar as Merchant of Record. Taxes, invoices and receipts are handled by Polar. License validation and revocation following a refund still apply. Existing licenses retain their original terms and actual issued expiry; they are not silently assigned this new contract. Any migration requires explicit agreement.
This is the approved offer for new purchases. Sales remain unavailable until the new one-time product, a non-expiring usage key, signed new-feature rights and recovery are verified in production. Do not use the previous recurring checkout to sell this offer.
3. Refunds
14 days from purchase, no questions asked. A refunded key is revoked and Pro stops working on the next license check.
Request a refund by emailing contact@lo9os.org within 14 days of purchase and include your order number; do not include your full license key. Polar processes approved refunds as Merchant of Record. Polar’s checkout terms govern payment processing: https://polar.sh/legal/checkout-buyer-terms. This refund policy does not limit consumer rights that applicable law does not allow us to exclude.
4. Restrictions
You may not transfer, redistribute, sublicense, resell, publish or share the Pro software or its license key with another party, nor remove or bypass license validation. These restrictions concern the software and license key; they do not restrict your use, sharing or sale of code, screenshots, reports or other work you create using the product. Rights in third-party content remain the responsibility of its rights holders.
5. What Pro sends over the network
Pro runs on your machine and has no servers of its own. Apart from reading the pages, source files and source maps of the sites you point it at, its only network call is to the Polar license API (api.polar.sh). What it sends there:
- from the command-line tool: the license key, the organization id, the benefit id, a device label (platform plus a short hash of the host name) and the activation id;
- from the Chrome extension: the same, except that the device label is the operating system plus a random install number that the extension makes for itself (no host name, no account).
Screenshots taken by the extension stay in the browser. Pages you pick elements on load their own scripts and make their own requests, as they do without design-pick; design-pick does not block or change them.
For data handling, storage and retention details, see the privacy policy: https://design-pick-privacy.groovybarge.chatgpt.site/.
6. Open-source components
The free design-pick command-line package is MIT-licensed and is not covered by this agreement. The Chrome extension is proprietary software and is covered by it.
7. Warranty and liability
Pro is provided "as is", without warranty. To the extent permitted by law, liability is limited to the fees you paid in the 12 months before the claim.
8. Governing law
Laws of the Republic of Korea.
